Abstract
If a school is short of space, the administrator might find that a lease or a licence is the best way forward, however there are a few rules of thumb which should be kept in mind. The article examines the issue in legal terms, covering topics including: the definition of a lease; agreement for lease; the definition of a licence; consents relating to the title of a property; other checks that should be made before entering a lease; agreement on fixtures and improvements; options to renew a lease; and retail leases. As with any important decision it is best to take all due care and consideration at the start rather than being left to deal with unexpected or unintended consequences at a later time.
